2. Scope and acceptance

These terms apply to purchases made through vogana.eu. By completing an order, you confirm that you are of legal age, have the legal capacity to enter into a contract and accept these terms together with the current Privacy Policy, Shipping Policy and Refund Policy.

The terms published when the order is placed will apply. We recommend keeping a copy of the confirmation and these terms.

3. Products, availability and sizing

VOGANA aims to display each product's features, colours and finishes as accurately as possible. Appearance may nevertheless vary slightly depending on the device or screen used.

All orders are subject to availability. If a product becomes unavailable after confirmation, we will notify you and refund the corresponding amount without undue delay using the original payment method, unless another solution is expressly agreed.

The size guide is indicative. Any specific product conditions will be shown on the product page before purchase.

4. Ordering process

1. Select the products, size and quantity and add them to your basket.
2. Review the order, enter your contact, billing and delivery details, and select the available delivery and payment methods.
3. Check the total, including taxes, shipping costs and any discounts.
4. Accept the terms and select the payment button to place an order carrying an obligation to pay.
5. Receive confirmation by email with the order number and summary.

The contract is formed when VOGANA sends the order confirmation. If you notice an error in your details, please contact us as soon as possible.

5. Prices, taxes and promotions

Displayed prices include applicable taxes. The final price, shipping costs and any other charges will be shown before payment is confirmed. VOGANA may change its prices, but changes will not affect confirmed orders.

Promotional codes, discounts and gifts are subject to their specific conditions, validity period, availability and any minimum spend. Unless stated otherwise, they cannot be combined or exchanged for cash.

If a return means that an order no longer meets a promotion's conditions, the promotional gift must also be returned. Otherwise, its previously disclosed value may be deducted from the refund.

6. Payment and security

You may pay using the methods offered during checkout. Charges are processed under the conditions of the selected method. The card or payment provider may decline a transaction; VOGANA is not responsible for delays or refusals attributable to that provider.

Transactions are processed in secure environments and payment information is encrypted in transit. VOGANA may carry out reasonable fraud-prevention checks and request additional information where necessary.

7. Shipping and delivery

Shipping costs

• Mainland Spain and Portugal: €4.95; free from €150. During sale periods, free from €300.
• Balearic Islands: €9.90.
• Canary Islands: €14.95.
• Ceuta and Melilla: €29.90.
• Azores and Madeira: €24.95.
• Other destinations: the cost is calculated automatically after the delivery address is entered.

Estimated delivery times

• Mainland Spain: 48–72 business hours.
• Balearic Islands and Portugal: 4–7 business days.
• Canary Islands, Ceuta and Melilla: 5–7 business days.
• Rest of Europe: up to 12 business days from dispatch confirmation.

Orders are not dispatched or delivered on Saturdays, Sundays or public holidays. Times are estimates and may be affected by circumstances beyond VOGANA's control. Consumer rights concerning delayed delivery remain unaffected.

Risk of loss or damage passes to the customer when the customer, or a nominated third party other than the carrier, takes physical possession of the order.

8. Pre-orders

Pre-order products will be delivered within the timeframe shown on their product page. If an order includes other products, it may be shipped together once all items are available. To request partial delivery, email online@vogana.es; any additional cost will be disclosed before processing.

9. Order cancellation

If you wish to cancel your order, you may request cancellation directly through our website during the first hour after placing the order, provided the system allows it.

Cancellation must be completed using this option and will be free of charge.

Once this period has passed, or if preparation has progressed and the system no longer permits cancellation, we cannot process it manually.

If the order has already been shipped, you may request a return after receiving it through our exchanges and returns portal.

If the customer refuses delivery, the refund will be processed after the parcel returns to our warehouse, less the applicable return costs.

10. Statutory right of withdrawal

If you purchase as a consumer, you may withdraw from an online purchase without giving a reason within 14 calendar days from the day on which you, or a nominated third party other than the carrier, take physical possession of the product. For products delivered separately, the period starts upon receipt of the last item.

To exercise this right, clearly notify VOGANA before the deadline through the returns portal, by email to vogana@vogana.es or by post to the address above. You may use the statutory withdrawal form, but this is not mandatory.

After notifying us, return the products without undue delay and no later than 14 calendar days thereafter. Unless VOGANA offers to bear them, direct return costs are payable by the customer and will be displayed in the portal before confirmation.

VOGANA will refund payments received, including the standard delivery cost corresponding to the least expensive standard method offered for the order, within the statutory period. We may withhold the refund until the products are received or you provide evidence of return. Refunds use the original payment method unless expressly agreed otherwise and incur no additional fee.

You are responsible only for any diminished value caused by handling beyond what is necessary to establish the product's nature, characteristics and functioning.

Exceptions to the right of withdrawal

The right does not apply in cases provided by law, including goods made to the customer's specifications or clearly personalised, and sealed goods unsuitable for return for health protection or hygiene reasons once unsealed. These exceptions apply only where their legal requirements are met.

11. Commercial exchanges and returns policy

Without affecting the statutory right of withdrawal, VOGANA offers a 15-calendar-day commercial exchanges and returns policy:

• Online order with delivery: from receipt.
• Online order collected in store: from the availability notice.
• In-store purchase: from the purchase date.

Items must be returned unused beyond reasonable inspection, with all labels intact—including the “NO ME CORTES” label—and preferably in their original packaging. Conditions, costs and exclusions are set out in the Refund Policy.

Commercial limitations concerning “SPECIAL PRICE”, “OUTLET”, private-sale or swimwear items do not restrict consumers' mandatory statutory rights.

12. Faulty or incorrect products

If you receive a faulty, damaged or incorrect product, contact VOGANA as soon as possible with your order number and, where helpful, photographs of the item and packaging.

13. Gift cards

Gift cards are governed by the conditions displayed on their product page and during purchase. They cannot be exchanged for cash unless required by law. A refund for a product paid wholly or partly by gift card will be made to the same instrument or an equivalent solution, without affecting statutory consumer rights.

14. Fraud prevention and accounts

VOGANA may take proportionate measures to prevent fraud and misuse. Where objective indications of fraudulent activity or unusual patterns arise, it may request clarification, temporarily restrict an account or cancel an order, while respecting applicable law and user rights.

15. Liability and force majeure

VOGANA is responsible for performing its obligations under applicable law. It is not liable for failures caused by unforeseeable or unavoidable events outside its reasonable control, without prejudice to consumers' mandatory rights.

Nothing in these terms excludes or limits liability that cannot legally be excluded or limited.

16. Personal data

Personal data provided during purchase is processed to manage the order, payment, delivery, after-sales support and legal obligations in accordance with the Privacy Policy.

Consumers may contact the competent public consumer authorities. Where applicable, VOGANA will provide information about its participation or willingness to participate in an alternative dispute-resolution procedure.

18. Governing law and jurisdiction

These terms are governed by Spanish law, without prejudice to any mandatory protection granted to consumers under the law of their country of residence.

Disputes will be submitted to the courts having jurisdiction under applicable law. Consumers retain the right to bring proceedings before the courts of their domicile where the law so provides.

19. Amendments and validity

VOGANA may update these terms to reflect legal, technical or operational changes. Updates will not apply retroactively to confirmed orders.

If any provision is held invalid or unenforceable, the remaining provisions will continue in effect.
